Commercial & Statutory Compliance Services
BACKGROUND: These Terms and Conditions, together with any and all other documents referred to herein, set out the terms under which We provide Our Services to Customers. Please read these Terms and Conditions carefully and ensure that you understand them before ordering any Services from Us. You will be required to read and accept these Terms and Conditions when ordering Services.
1. Definitions and Interpretation
In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

| “Business Customer” | A Customer who is acting for purposes relating to their trade, business, craft, or profession. |
| “Consumer” | An individual acting wholly outside of their trade, as defined by the Consumer Rights Act 2015. |
| “Order / Quotation” | The Customer’s initial request and Our written quotation detailing the scope of the Services and the Quoted Fee. |
| “Services” | The electrical inspection, testing, thermal imaging, installation, repair, and maintenance services to be provided by Us as specified in the accepted Quotation. |
| “We/Us/Our” | TMUK Group Ltd, a company registered in England and Wales. Company Number: 10771597. VAT number: GB2712138 29. |
2. Information About Us
- We are registered with a recognised and authorised self-certification scheme for electrical work.
- We hold valid and suitable insurance, including Public Liability Insurance with a limit of indemnity of at least £5 million.
3. The Contract & Quotation Validity
We accept Orders via our website, email, or telephone. A legally binding Agreement is created upon the Customer’s clear, affirmative acceptance of Our Quotation.
Validity of Quotation: All Quotations are strictly valid for 30 days from the date of issue. Due to fluctuating material costs and supply chain volatility, if the 30-day period expires before acceptance, TMUK Group Ltd reserves the absolute right to requote. Furthermore, if a specific brand or model number specified in the Quotation becomes unavailable, TMUK Group Ltd reserves the right to supply and install materials of a similar or higher quality to complete the works.
4. Site Access, Disruption & Client Responsibilities
4.1 Unhindered Access
The Client must ensure that TMUK Group Ltd engineers have safe, continuous, and unhindered access to the premises, including all distribution boards, switchgear, and necessary circuit endpoints during agreed working hours. We do not move heavy machinery or furniture to gain access.
4.2 Pre-Testing Shutdowns (EICR)
To safely carry out Fixed Wire Testing (EICR), power must be completely isolated. Software shutdowns of equipment are the absolute responsibility of the client. This includes IT servers, NAS drives, HVAC chillers, and Process Machinery.
Liability Disclaimer: TMUK Group Ltd accepts no liability whatsoever for data loss, server corruption, or mechanical failure resulting from the necessary isolation of the electrical supply during testing.
5. Boundaries of Service
5.1 Thermal Imaging Surveys (Thermography)
A Thermal Imaging Survey is a non-destructive diagnostic tool used to identify anomalous thermal activity. The survey relies on line-of-sight and the thermal conditions present at the exact time of the inspection.
- The survey identifies temperature variations; it does not explicitly diagnose the electrical fault causing the heat.
- It is the responsibility of the Client, or a subsequent electrical contractor, to investigate the anomaly, determine if the heat profile warrants remedial action, and enact repairs.
- TMUK Group Ltd will not be held liable for faults that develop after the survey or anomalies hidden behind physical barriers (e.g., locked panel doors).
5.2 Working at Height
Unless explicitly detailed in the agreed quotation, works are limited to a maximum height of 3 metres using standard step ladders. If MEWPs (Mobile Elevating Work Platforms), scaffolding, or specialist access equipment are required on site, the cost and provision of these are the responsibility of the Client.
5.3 Exclusions of Liability: Property Damage & “Making Good”
TMUK Group Ltd is solely an Electrical Contracting Company. We do not provide plastering, painting, decorating, or general building services.
During the execution of electrical installations, repairs, or rewiring, it is often necessary to lift floorboards, chase out channels in brickwork, or cut into plasterboard to run cables. While Our engineers will take all reasonable care to minimise disruption, We accept no responsibility or liability for the “making good” of any cosmetic or structural damage. It is the Customer’s sole responsibility to arrange and fund any subsequent remedial trades required.
6. Financial Terms & Conditions
6.1 Payment Terms
Invoices are raised upon completion of the site works. Payment terms are strictly 30 days from the date of invoice.
Report Verification & Certificate Release
Following site works, inspection data must be compiled, verified, and signed off by our Qualified Supervisors. Due to administrative backlog, report size, and seasonal variations (e.g., school holidays, Christmas), the production of final reports can take up to 30 days.
TMUK Group Ltd retains the intellectual property and legal ownership of all certification, data logs, and reports until the associated invoice is paid in full. The 30-day report production timeframe strictly commences only upon the receipt of cleared funds in full. No certificates will be released to the Client prior to payment.
6.2 Late Payments
Business Customers: In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, any sums remaining unpaid after the 30-day period will incur statutory interest at a rate of 8% above the Bank of England base rate, calculated daily, plus fixed sum compensation for debt recovery costs.
Consumers: If you fail to make payment by the due date, We may charge you interest on the overdue sum at a rate of 4% above the Bank of England base rate.
7. Cancellations
7.1 Business Customers
If a Business Customer wishes to cancel or reschedule agreed works with less than 48 hours’ notice, TMUK Group Ltd reserves the right to charge a cancellation fee equal to 50% of the anticipated day rate for the assigned engineers to cover administrative costs and loss of scheduled work. Cancellations on the day of arrival will incur a 100% abortive charge.
7.2 Consumers (The Cooling-Off Period)
Consumers have a statutory right to a 14-day “cooling-off period” under the Consumer Contracts Regulations 2013. If you explicitly request that We begin providing the Services within this 14-day period, you acknowledge that you will lose your right to cancel once the Services are fully completed. If you cancel after Services have begun, you must pay for the Services supplied up to the point of cancellation.
8. General Liability & Governing Law
Nothing in these Terms and Conditions seeks to limit or exclude Our liability for death or personal injury caused by Our negligence, or for fraud or fraudulent misrepresentation. Subject to this, We shall not be liable to the Customer for any loss of profit, loss of business, or any indirect or consequential loss arising under or in connection with the Agreement.
These Terms and Conditions, and the relationship between you and Us, shall be governed by, and construed in accordance with, the laws of England and Wales.
